Benchboom is a community opinion and entertainment platform that allows users to post and vote on fantasy-sports-related questions such as "Who Do I Start?" ("WDIS"). The Service is intended for amusement, discussion, and crowd insight only—it does not provide professional fantasy or gambling advice and should not be relied on for monetary or wagering purposes.

2. Eligibility

Benchboom is available to users worldwide. By using the Service, you represent that you are legally able to enter into these Terms in your jurisdiction.

3. Account Registration and Verification

To use certain features, including posting or commenting, you must create an account.

• Email Verification: You may vote and post without verifying your email, but you must verify your email address to leave written comments on WDIS posts or other user content.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• Communications: By creating an account, you agree that Benchboom may contact you at your registered email address with information relevant to your account, the operation of the Service, or important updates that may affect your experience. These communications are considered part of your account relationship and are not promotional in nature.

4. User Conduct

You agree to use the Service responsibly and not to:

• Harass, threaten, impersonate, or discriminate against any user or group.
• Use language, profile images, or usernames that are obscene, hateful, defamatory, or otherwise inappropriate.
• Attempt to manipulate votes, leaderboard rankings, or the point system through automation, fake accounts, bots, or coordinated activity.
• Post any content that violates applicable laws, infringes intellectual property, or invades privacy.

We reserve the right, at our sole discretion and with or without notice, to:

• Change or remove profile names or images we deem inappropriate.
• Remove any content that violates these Terms or undermines the integrity of the platform.
• Suspend, delete, or permanently ban accounts that jeopardize the safety, integrity, or utility of the Service.

5. Platform Behavior and Limitations

• Votes on WDIS posts close automatically when a relevant game begins. Benchboom is not responsible if a user fails to receive the number of votes they anticipated before a game starts.
• Benchboom is not responsible for any issues arising from last-minute schedule or roster changes, injuries, or other unpredictable events.
• The Service and its features are provided "as is" and "as available." We make no guarantees regarding vote volume, accuracy, or the availability of the platform.

6. Virtual Economy and Points System

Benchboom features a virtual points system that allows users to earn and spend points through participation (e.g., voting, posting, or engaging with the community).

• Points have no monetary value and cannot be exchanged for cash or goods outside the platform.
• We reserve the right, at any time and without notice, to modify point values, posting costs, reward structures, or any other aspect of the in-app economy.
• We also reserve the right to introduce paid or premium features in the future. Any applicable fees or subscription terms will be communicated in advance.

7. Content Ownership and Responsibility

You retain ownership of the content you create, but by posting, you grant Benchboom a non-exclusive, royalty-free, worldwide license to display, distribute, and use that content to operate and promote the Service.

Benchboom is not responsible for the accuracy, reliability, or appropriateness of user-generated content, including votes, comments, or posts. We reserve the right to remove or moderate content that violates these Terms or our community standards.

8. Privacy and Data Use

We collect limited user data such as account information, votes, and interaction analytics to improve leaderboard accuracy, maintain service performance, and prevent abuse.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. Benchboom makes no guarantees regarding accuracy of predictions, user participation, platform availability, or error-free operation.

12. Limitation of Liability

To the fullest extent permitted by law:

• Benchboom shall not be liable for any indirect, incidental, or consequential damages arising out of your use of or inability to use the Service.
• You agree that your sole remedy for dissatisfaction with the Service is to stop using it.

13. Indemnification

You agree to indemnify and hold harmless Benchboom and its affiliates, officers, and employees from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

Any dispute arising from or relating to the Service shall be resolved through binding arbitration in San Francisco County, California, under the rules of the American Arbitration Association.
